USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Application has been amended as shown below.  As agreed to by attorney of record Karen C. Kline, Esq. on October 15, 2019, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

IDENTIFICATION OF GOODS AND SERVICES

 

The identification of goods and services in Class 9 and 42 ONLY is amended to read as follows:   

 

Class 9:  Automation systems and equipment, namely, mechanical and electronic devices in the nature of electric sensors, industrial robots, cameras used to automatically locate, alter, inspect, test or sense materials or products as part of automated processes; computer hardware, namely, computerized vision systems hardware; downloadable computer software for saving images and data, communicating with remote interfaces, controlling actuators, robotic guidance, cap and color inspection, in the field of automation systems, namely, vision systems, production planning software, automation software, machine control software, maintenance software; downloadable factory automation software, namely, software to integrate manufacturing machine operations, track problems and generate production reports; downloadable computer software for saving images and data, communicating with remote interfaces, controlling actuators, robotic guidance, cap and color inspection, in the field of data integration for factory automation and manufacturing; all for the use in factory automation

 

Class 42:  Design of automation and manufacturing systems, namely, industrial automation machinery for use in the manufacture, assembly, handling and packaging of goods for others, and consultation related thereto; installation of automation and manufacturing software; maintenance of automation and manufacturing software; consulting services regarding the analysis, design, development, and implementation of automation and manufacturing computer systems and automation systems; consulting services regarding the evaluation of the structural properties of automation and manufacturing computer systems and automation systems; consulting services regarding the evaluation of automation and manufacturing computer systems and automation systems to determine conformity with certification standards or to assure compliance with industry standards; consulting services regarding the maintenance of automation and manufacturing computer software systems and automation software systems; research related to the computerized automation of industrial processes; research related to the computerized automation of technical processes; research in the field of manufacturing machinery; computer services, namely, providing a website featuring on-line non-downloadable software tools for the management, monitoring, and integration of manufacturing data of automation and manufacturing machinery; computer services, namely, providing web servers to third party computing and data storage facilities for the management, monitoring, and integration of manufacturing data of automation and manufacturing machinery; all of the foregoing for the use in factory automation

GENERAL PROCEDURAL INFORMATION
