EXAMINER’S AMENDMENT
Issue date: December 09, 2019
Application has been amended as shown below. As agreed to by Carissa Kranz on December 4, 2019, the examining attorney has amended the application as shown below. Please notify the examining attorney immediately of any objections. TMEP §707. Otherwise, no response is required. Id. In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted. 37 C.F.R. §2.71(a).
AMENDED DESCRIPTION OF THE MARK
The following description of the mark replaces the current description of record:
The mark consists of an incomplete, single line circle with the wording "VEGAN" at the top of the circle and the transparent letter "V" appearing within an upside-down triangle under "VEGAN" in the center of the circle. The wording "BEVVEG!" connects the curved lines of the circle to form the bottom of the circle. The letter “V” in the wording “BEVVEG!” is transparent and appears within an upside-down triangle. The white in the mark represents background and is not claimed as a feature of the mark.
See 37 C.F.R. §§2.37, 2.72; TMEP §§808 et seq.
Based on the Examiner’s Amendment and applicant’s response dated November 18, 2019, the following requirement(s) are satisfied: (1) Drawing of the Mark, (2) Amended Description of Mark and Color Claim Required, and (3) Mark Image Unclear. See TMEP §707.03.
