Importance: High

Mr. Larson,

I am writing in reference to U.S. Trademark Application Serial No. 88214753, for the mark DRYMATE SURFACE PROTECTION in stylized characters and with a design.  The amended identification of goods submitted with applicant’s April 22, 2019 response to the March 5, 2019 Office action requires additional amendment, as we discussed on the telephone earlier today.  The following wording is suggested (please note that any added wording is indicated with bold type, while any deleted wording is indicate with a strike through):

“Absorbent protective slip-resistant waterproof polyester mats and pads for lining shelves; Absorbent protective slip resistant waterproof polyester mats for use as shelf liners; Absorbent protective slip-resistant waterproof polyester mats in the nature of shelf liners for use on platforms under sinks” in International Class 20.

“Absorbent protective slip-resistant waterproof mats in the nature of pet litter box liners for use in pet crates and dog crates; Absorbent protective slip-resistant waterproof mats in the nature of pet litter box liners for use in pet whelping boxes; Absorbent protective slip-resistant waterproof dish drying mats for use in drying dishes on counter tops and under dish racks” in International Class 21.

“Absorbent protective slip-resistant waterproof polyester fabric mats in the nature of reusable housebreaking pads for use in pet crates and dog crates; Absorbent protective slip-resistant waterproof mats in the nature of reusable housebreaking pads of fabric for use in pet whelping boxes; Absorbent washable protective slip-resistant waterproof mats in the nature of reusable housebreaking pads of polyester fabric composition for use in pet potty training” in International Class 24.

“Absorbent protective slip-resistant waterproof mats and pads in the nature of floor mats for use on floors, shelves, and patios; Absorbent protective slip-resistant waterproof floor mats for use under pet bowls, dog bowls, and cat bowls; Absorbent protective slip-resistant waterproof floor mats for use under cat litter boxes; Absorbent protective slip-resistant waterproof floor mats for use in under pet crates and dog crates; Absorbent protective slip-resistant waterproof floor mats for use in under pet whelping boxes; Absorbent washable protective slip-resistant waterproof mats for use in pet potty training, namely, floor mats; Absorbent protective slip-resistant waterproof mats for use in drying dishes on counter tops and under dish racks; Absorbent protective slip resistant waterproof floor mats for use on floors and platforms under sinks; Absorbent protective slip-resistant waterproof mats for use as shelf liners; Absorbent protective slip-resistant waterproof floor mats for use beneath grills on floors, and patios” in International Class 27.

Please let me know as soon as possible if the above suggested wording is acceptable, and if so, I would be glad to issue an Examiner’s Amendment for the change and update the record accordingly.

Sincerely,

Carl A. Konschak, Esq.
