Introduction

 

This examiners amendment is in response to applicant’s petition to revive filed on October 30, 2019.

 

In a previous Office action dated February 14, 2019, the applicant was required to satisfy the following requirements:  provide the application verification statements and date of signing, provide a mark description, and provide the foreign registration for Section 44(e) registration.

 

Based on applicant’s response, the trademark examining attorney notes that all requirements have been satisfied.  See TMEP §§713.02, 714.04. 

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Mr. Timothy C. Dunn, Esq. on November 15, 2019, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

Unnecessary Disclaimer

 

The petition to revive includes a disclaimer of the following matter in the applied-for mark:  “MANDY.”  An applicant may voluntarily disclaim matter in a mark regardless of whether the matter is registrable.  TMEP §1213.01(c); see 15 U.S.C. §1056(a).  However, a disclaimer of this matter is not required. Applicant has therefore requested to withdraw this disclaimer from the application.
