Subject: U.S. Trademark Application Serial Nos. 88207517 and 88207560

Dear Ms. Kundrotas:

I have examined the above-referenced applications that include identical identifications of goods.  Before the marks are approved for publication, an amendment to the identification of goods for Classes 5 and 21 for each application is required.  Please see below.

Pet stain removers; odor removers for pets; pet shampoo; pet hair conditioner; pet deodorant; cleaning solution for pet bowls, pet toys, and pet feeders; grooming preparations for pets, namely, pet wipes pre-moistened with a cleaning agent to clean coat and paws; combination cleaner, sanitizer and deodorizer for litter boxes and pet crates, cages, and kennels; carpet shampoos; fabrics, upholstery and surface cleaners; non-medicated pet wipes for cleansing and deodorizing; combination cleaners and deodorizers for use on pets, namely, dander remover and deodorizer – Class 3; [ACCEPTABLE]

Indoor and outdoor [must specify type of repellent] repellent sprays for dogs and cats; odor neutralizing preparations for animal-related use, namely, odor removers [wording “for animal-related use, namely, odor removers” is unacceptable because “odor removers” are not Class 5 goods—may simply delete the wording] for application to cat litter; carpet deodorizers and room deodorizer compositions; animal deterrent [wording “animal deterrent” is inaccurate because the purpose of the preparations is to prevent causing a skin condition and not deter an animal—must identify good by specifying whether it is medicated or non-medicated for proper classification purposes, e.g., medicated preparation applied to affected area of dog's coat to prevent fur biting, hair chewing, and skin scratching – Class 5; or non-medicated preparation applied to affected area of dog’s coat to prevent fur biting, hair chewing, and skin scratching – Class 3] preparation applied to affected area of dog's coat to prevent fur biting, hair chewing, and skin scratching – Class 5;

Applicant may adopt the following, if accurate:

Indoor and outdoor insect repellent sprays for dogs and cats; odor neutralizing preparations for application to cat litter; carpet deodorizers and room deodorizer compositions; medicated preparation applied to affected area of dog’s coat to prevent fur biting, hair chewing, and skin scratching– Class 5;

Scoops for disposal of pet waste; household storage containers for pet food; grooming tools for pets, namely, pet hair remover sponges; grooming and cleaning devices, namely, pet hair remover rollers, pet hair and lint removers [the term “removers” is vague--specify, e.g., in the form of rakes], pet hair and fur remover brushes, pet hair removers [the term “removers” is vague--specify, e.g., in the form of rakes] for use on carpets, and combs and brushes for removing pet and animal hair – Class 21;

Applicant may adopt the following, if accurate:

Scoops for disposal of pet waste; household storage containers for pet food; grooming tools for pets, namely, pet hair remover sponges; Grooming and cleaning devices, namely, pet hair remover rollers, pet hair and lint removers in the form of rakes, pet hair and fur remover brushes, pet hair removers in the form of rakes for use on carpets, and combs and brushes for removing pet and animal hair – Class 21;

With your permission, I can enter the amendments via an Examiner’s Amendments and approve the marks for publication.
