Dear Mr. Clarke,

 

I am the trademark examining attorney at the United States Patent and Trademark Office reviewing your above-referenced trademark application. I just received the SOU, and see that it shows used of goods containing CBD. We need to clarify that these goods contain CBD derived only from legal sources. Additionally, supplements containing CBD are not allowed without FDA approval. If the changes below, with amended language in underlined font, are acceptable, I will issue an examiner's amendment accordingly:

 

Class 3: Cosmetics, namely, lotion, skin cream, and non-medicated general purpose ointments, all of the foregoing not for medical use and containing CBD derived solely from hemp

 

If you agree to the amendments above, I can make the change for you via an Examiner’s Amendment. However, you will also need to amend the filing date to 12/20/2018, which was the first legal date for CBD derived from hemp. I cannot do that for you; you will need to file a formal submission under declaration.
