In response to the substantive refusal(s), please note the following:

The Examining Attorney is thanked for the action. Applicant appreciates the indication that there are no registered or pending marks that would bar registration under Trademark Act Section 2(d). The ornamental refusal is noted but respectfully traversed, as the mark acts as a source indicator on the specimen submitted. Nevertheless, to facilitate a compact examination, this application is hereby converted to an ITU form. A substitute specimen will be submitted upon receipt of a notice of allowance, which is hereby requested. David Judson Reg. No. 30467
