I am the trademark examining attorney at the United States Patent and Trademark Office reviewing your above-referenced trademark application, and I wanted to discuss the following issues with you.
Identification of Goods: The application requires amendments to the identification of goods because the current language is unacceptably indefinite. If the changes below, with amended language in red and underlined font, are acceptable, I will issue an examiner's amendment accordingly:
Class 9: “Downloadable computer application software for mobile phones and handheld electronic devices, namely, software for health tracking, stress reduction, sleep enhancement, sleep tracking, diet tracking, exercise and fitness tracking, mood evaluation and tracking, personal wellness goal setting, providing surveys and feedback relating to sleep and wellness, providing optional wellness activities and exercises which promote longevity, personal motivation, tips for enhancing wellness and sleep, facilitating healthy behavior in others through encouragement, identifying activities and behaviors to promote health, tracking activities and behaviors using scores and checklists for sleep, fitness, stress relief, exercise, nutrition, meditation, reflection, and hydration, projecting time added to lifespan based on activity and behaviors.”
