RE: US Serial No. 88197606 - NAT   Hello.   We had discussed 2 issues regarding this application:  Significance and ID.   SIGNIFICANCE:   You had indicated that NAT does not have any significance with respect to the applicant’s goods.      IDENTIFICANTION OF GOODS   This application currently has the following wording in the ID:                  Computer application software for mobile device, namely, software for remotely capturing images and video, streaming of audio visual and audiovisual material via a global computer network   We had spoken by phone today about incorporating wording that tracks the proposed language from the co-pending application for SEGO  (US APP SERIAL NO 88157614).  Such an amendment could look like the wording shown immediately below in Class 9, with amended wording shown in blue.   Note that the SEGO application does not contain “streaming of audio visual and audiovisual material.”               Downloadable computer application software for mobile device, namely, software used in connection with lenses for remotely capturing images and video, streaming of audio visual and audiovisual material for general use             via a global computer network.   A reminder that applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended. See 37 C.F.R. §2.71(a); TMEP §1402.06.   I will await further word from you regarding possible Examiner’s Amendment on both the significance and ID issues discussed here.   Sincerely,   Hope E. Hello.   We had discussed 2 issues regarding this application:  Significance and ID.

SIGNIFICANCE:

You had indicated that NAT does not have any significance with respect to the applicant’s goods.

IDENTIFICANTION OF GOODS

This application currently has the following wording in the ID:

Computer application software for mobile device, namely, software for remotely capturing images and video, streaming of audio visual and audiovisual material via a global computer network

We had spoken by phone today about incorporating wording that tracks the proposed language from the co-pending application for SEGO  (US APP SERIAL NO 88157614).  Such an amendment could look like the wording shown immediately below in Class 9, with amended wording shown in blue.   Note that the SEGO application does not contain “streaming of audio visual and audiovisual material.”

Downloadable computer application software for mobile device, namely, software used in connection with lenses for remotely capturing images and video, streaming of audio visual and audiovisual material for general use

            via a global computer network.

Sincerely,

Hope E. Slonim
