TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

SEARCH OF OFFICE’S DATABASE OF MARKS
APPLICANT MUST CLARIFY ITS IDENTIFICATION OF GOODS AND SERVICES
Certain wording in the identification is indefinite or overly broad and must be clarified. See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03, 1904.02(c), (c)(ii). Please see the notes and suggested amendments below.
Additionally, applicant did not designate in the application the required international class number(s) for applicant’s services. Thus, the USPTO conducted a preliminary review of the specified services and assigned an international class number(s). See TMEP §1401.03(b). However, in this case, the USPTO incorrectly classified the services in International Class 9; the correct international class number for some of the applicant’s specified services (as indicated below) is International Class 42. Therefore, applicant may respond by (1) adding International Class 42 to the application and reclassifying these services in the proper international class, (2) deleting “non-downloadable software to provide educational services, training services and tools provided via simulators relating to investing; non-downloadable software that provides information about market data including past performance of particular investments and markets, helps plan investment strategies and investment decision-making” from the application, or (3) deleting the remainder of the items in the identification and reclassifying the specified services in the proper international class. See 37 C.F.R. §§2.86(a), 6.1; TMEP §§1403.02 et seq. If applicant adds one or more international classes to the application, applicant must comply with the multiple-class requirements specified in this Office action.
Applicant may substitute the following wording, if accurate:
International Class 9: DOWNLOADABLE financial and investment software, NAMELY, {applicant must identify the function of the software, e.g., software for tracking the value of investments};
INTERNATIONAL CLASS 42: PROVIDING NON-DOWNLOADABLE
financial and investment software, NAMELY, {applicant must identify the function of the software, e.g., software for tracking the value of
investments}; non-downloadable software to provide educational services, training services and tools provided via simulators relating to investing {It is unclear from the wording if the software is for consumers who wish to learn about investing, or if the software is for educators who wish to provide instruction to others in the field
of investing. Applicant must provide clarification as to the nature of the goods, e.g., Providing temporary use of non-downloadable software featuring instruction,
training, and training simulators, all in the field of investing}; non-downloadable software that provides information about market data including past performance of particular investments
and markets, helps plan investment strategies and investment decision-making

MULTI-CLASS REQUIREMENT
(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule). The application identifies goods and/or services that are classified in at least 2 classes; however, applicant submitted a fee(s) sufficient for only 1 class. Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

ASSISTANCE
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
