To the Commissioner for Trademarks:

Application serial no. 88192713 ASEM(Standard Characters, see http://uspto.report/TM/88192713/mark.png) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

With respect to the indication that Applicant's mark "ASEM" is merely a surname, Applicant respectfully submits that the term ASEM has a meaning other than a surname. The intended meaning of "ASEM" is "providing 'A'-level (best) services in the field of semiconductor ('SEM') IP business. In relation to the goods/services, "ASEM" means A-level legal/consultation services in the field of semiconductor IP business.

As for the recognition of the meaning of the "ASEM," Applicant has already provided a relevant brochure and letterhead related to the "ASEM" mark and services.

Since "ASEM" has not been recognized as a strong surname in the U.S. and in view of the services (i.e., legal/consultation services) in the field of semiconductor IP business, it would be considered that the "ASEM" surname is rare, and the "ASEM" cannot be primarily merely a surname with respect to ordinary U.S. customers in the pertinent field.

Therefore, Applicant respectfully requests withdrawal of the Section 2(e)(4) refusal.
