Application has been amended as shown below.  As agreed to by Mr. Kevin Viau, Esq. on February 13, 2020, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

Please note:  As discussed with applicant’s attorney, the amended mark description overcomes the requirement for an amended drawing of the mark.

 

MARK DESCRIPTION

 

The following description of the mark is added to the record:

 

            The mark consists of a three-dimensional configuration of a bottle. The design is comprised of a graphic consisting of the stylized writing of “alō” in white within a light green rounded square shape appearing on the front label of the bottle; and the image of two aloe vera leaves in green appearing on the front of the bottle and extending to the side labels of the bottle; the image of the two aloe vera leaves in green is repeated on the reverse side of the bottle, extending also onto the side labels of the bottle. The matter shown in broken lines indicates placement of the design elements in the mark and thus is not claimed as a feature of the mark.
