SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
DISCLAIMER REQUIRED
In this case, applicant must disclaim the wording “SINCE 1932” in the mark because it is not inherently distinctive. These unregistrable term(s) at best are merely informational about the goods and are commonly used in applicant’s industry to indicate the date of establishment of the business and the date in which applicant first started operations and began selling it goods; thus the term(s) do not function as a mark. See 15 U.S.C. §§1051-1053, 1127; In re Boston Beer Co., 198 F.3d 1370, 1372-74, 53 USPQ2d 1056, 1058-59 (Fed. Cir. 1999); In re Aerospace Optics, Inc., 78 USPQ2d 1861, 1864 (TTAB 2006); TMEP §§807.14(a), 1202.04, 1213.03(a), (b).
Determining whether a term functions as a trademark mark depends on how such matter would be perceived by the relevant public. In re Eagle Crest, Inc., 96 USPQ2d 1227, 1229 (TTAB 2010); In re Aerospace Optics, Inc., 78 USPQ2d at 1862; TMEP §1202.04. “The more commonly a [term] is used, the less likely that the public will use it to identify only one source and the less likely that it will be recognized by purchasers as a trademark.” In re Hulting, 107 USPQ2d 1175, 1177 (TTAB 2013) (quoting In re Eagle Crest, Inc., 96 USPQ2d at 1229); TMEP §1202.04.
These unregistrable term(s) at best are merely informational about the goods and are commonly used in applicant’s industry to indicate the date of establishment of the business and the date in which applicant first started operations and began selling it goods. Because consumers are accustomed to seeing these term commonly used by many businesses to impart information to consumers, they will perceive this term or slogan only as informational matter rather than as a trademark that identifies the source of applicant’s goods.
Applicant must also disclaim the wording “FORT COLLINS, COLORADO” in the mark because it is not inherently distinctive. These unregistrable term(s) are at best primarily geographically descriptive of the origin of applicant’s goods. See 15 U.S.C. §§1052(e)(2); In re Societe Generale des Eaux Minerales de Vittel S.A., 824 F.2d 957, 959, 3 USPQ2d 1450, 1451-52 (Fed. Cir. 1987); TMEP §§1210.01(a), 1210.06(a), 1213.03(a).
FORT COLLINS, COLORADO, is a generally known geographic place or location. See TMEP §§1210.02 et seq. The goods for which applicant seeks registration originate in this geographic place or location as shown by applicant’s address. See TMEP §1210.03. Because the goods originate in this place or location, a public association of the goods with the place is presumed. See In re Hollywood Lawyers Online, 110 USPQ2d 1852, 1858 (TTAB 2014) (citing In re Spirits of New Merced, LLC, 85 USPQ2d 1614, 1621 (TTAB 2007)); TMEP §§1210.02(a) 1210.04.

REGISTRATION SYMBOL MUST BE DELETED FROM DRAWING
Applicant must submit a new drawing with the ® Registration symbol deleted from the drawing of the mark; this symbol is not part of the mark and is not registrable. See 37 C.F.R. §2.72; TMEP §807.14(a). Although applicant must delete this matter, applicant may not make any other changes or amendments that would materially alter the drawing of the mark. MARK DESCRIPTION – AMENDMENT REQUIRED
The following description is suggested, if accurate: The mark consists of concentric circles with the words "DEVELOPED", "TESTED" and "TRUSTED", with a small circle on both sides of the word "TESTED", located between the two concentric circles at the top and the words “FORT COLLINS, COLORADO” between the two concentric circles at the bottom and a stylized ribbon overlaid across the lower part of both the circles with the word FORNEY in stylized type inside the ribbon and above the ribbon the inner circle is split into two equal parts by a vertical line wherein to the left of the vertical line are 9 stars and 2 half stars and to the right of the vertical line are 5 stripes and which form a highly stylized, incomplete and unusually shaped America flag which is obstructed partially by the concentric circles and the ribbon. Below the ribbon in the lowest part of the innermost concentric circle appears the wording “SINCE 1932”.
RESPONSE GUIDELINES
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.
