EXAMINER’S AMENDMENT

 

 

Issue date:  August 09, 2019

 

Applicant filed a response to the outstanding Office action associated with this application on July 22, 2019, in which applicant was required to amend the International Class 5 and 11 identifications of goods. Applicant responded by amending the International Class 5 identification appropriately (and deleting the International Class 11 identification). See TMEP §§713.02, 714.04. 

 

Applicant also added International Class 32 to the application. Applicant’s proposed International Class 32 identification, however, required further clarification, which necessitates the issuance of this Examiner’s Amendment.

 

IDENTIFICATION OF GOODS AMENDED

 

As agreed to by Lisa Caldwell on August 8, 2019, The International Class 32 identification of goods is amended to delete the wording “preparations in the nature of powders for making beverages.” The amended identification now reads as follows:

 

Powders used in the preparation of sports drinks

 

See TMEP §§1402.01, 1402.01(e).

 

Please notify the examining attorney immediately of any objections to this amendment; otherwise, no response is necessary. TMEP §707.  

 

At this time, barring some unforeseen circumstance that might require further action, the application appears ready for publication in the Trademark Official Gazette.
