Applicant’s Correspondence

This action responds to applicant’s correspondence filed June 15, 2020.  Applicant indicates that it is a wholly-owned subsidiary of Cascades Inc., the owner of cited U.S. Registration Nos. 3275615 and 3916468.  Applicant has also deleted International Class 5 from the application.  The Section 2(d) refusal is thus withdrawn.  The reference to U.S. Application Serial No. 87875320 is also withdrawn.  Applicant also submitted a copy of its foreign registration.  However, no translation of the foreign registration was submitted.  The following requirement is therefore now made.

Translation of Foreign Certificate

The applicant must submit an English translation of the foreign registration.  37 C.F.R. §2.34(a)(3)(ii); TMEP §1004.01(a)-(b).  The translation should be signed by the translator.  TMEP §1004.01(b).

GENERAL GUIDANCE

·         Check the status of your application periodically in the Trademark Status & Document Retrieval (TSDR) database to avoid missing critical deadlines.

·         Update your correspondence email address, if needed, to ensure you receive important USPTO notices about your application.

·         Beware of misleading notices sent by private companies about your application.  Private companies not associated with the USPTO use public information available in trademark registrations to mail and email trademark-related offers and notices – most of which require fees.  All official USPTO correspondence will only be emailed from the domain “@uspto.gov.”
