Dear Mr. Pham,

Your original identification of goods was for “electric night lights.” As such, the identification in the current application is restricted to “electric night lights” with amendments to clarify. However, please let me know if you would be comfortable with the following identification for the goods in class 11: “Electric night lights being string lights for festive decoration”.

Best Regards,

Carolyn

Noted.

But does your wording have to be so restricted. It's for daytime use too.

Dear Mr. Pham,

Thank you for your prompt response. Once an applicantion has been submitted, the identification of goods can only be amended to clarify or limit the goods, never to broaden or expand the goods past those in the original application.  Thus, the application cannot be expanded to include “lamps,” “light bulbs” or “electric lighting fixtures” (or something similar), although these goods could be covered in another application.

To move forward with your current application, I do need to further clarify your identification of goods as stated below. Please let me know if you approve of amending the goods in class 11 to the following:

International Class 011:  “Electric night lights being string lights for festive decoration for use at night”.

I am happy to further explain this situation over the phone if that would be helpful. Please give me a call at the number below.

Best,

Carolyn

Hi,

Great to hear from you.

These strings lights are decorative in the daytime too so please allow for this flexibility.

We would like the light category to be broader than what is stated. Is there a way where we could also include lamps, light bulbs too?

Dear Mr. Pham,

I am the trademark examining attorney handling the trademark application for DREAM TADA (88154650). In review, there is one issue that can be corrected without the need for an office action.

I require an amended identification of the goods identified in International Class 011 because the wording “electric night lights” must be clarified because it does not match the goods shown in the specimen. Specifically, the suggested identification would read, with suggested changes in bold:

International Class 011:  “Electric night lights being string lights for festive decoration for use at night”.

Please let me know if you would approve of my amending the identification as described.

If you have any questions, comments, or concerns please feel free to call or e-mail me using the information provided in my signature block below. Please respond no later than 2 PM EST on Wednesday, January 30, 2019. Thank you.

Best,

Carolyn Detmer
