Dear Attorney Morrison, 

 

Per our telephone conversation, the specimen requirement can be withdrawn.  That still leaves a minor ID issue that we can correct with an Examiner’s amendment (EA).

 

I propose we amend as follows:

 

Identification- class 32

 

The identification of goods in class 32 is amended to read as follows: 

 

Class 32:  soft drinks; soft drinks, namely, carbonated soft drinks and non-carbonated soft drinks made with coconut water, coconut lemonade, iced tea, or sparkling water; soft drinks made with herbs and spices, namely, carbonated soft drinks made with herbs and spices  and non-carbonated soft drinks made with herbs and spices

 

See TMEP §§1402.01, 1402.01(e).

 

 

Please let me know at your earliest convenience if you would agree to this change.  If so, I will enter via EA, and then approve the case.
