I am the examining attorney in the above referenced trademark application. There are two issues that require resolution.

 

First, the goods are currently classified in International Class 9, but are properly classified in International Class 10. Therefore, the goods should be reclassified in the proper International Class.

 

Second, the mark description and color claim require amendment to more fully and clearly describe the applied-for mark. The following wording is proposed and may be adopted:

 

               Color Claim:                        The colors red, blue, yellow, grey, dark grey, black, white, and peach are claimed as a feature of the mark.

 

Mark Description:             The mark consists of the stylized grey wording “RHINOSHIELD” featured below a circular design that is half red and half blue. Inside the circle design is a stylized rhinoceros head design featured in light and dark grey.  The rhinoceros is wearing yellow and blue sunglasses, is featured with a peach colored nose patch, and features a white tooth with a black mouth.  The rhinoceros design is outlined in black.  All other white areas represent background and are not claimed as a feature of the mark.
