DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Sandy Lipkin on January 20, 2019, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods may clarify or limit the goods, but may not add to or broaden the scope of the goods.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

CLASSIFICATION OF GOODS

 

The application is amended to classify the goods in International Class 10.  TMEP §1401.03(b); see 37 C.F.R. §2.85.

 

MARK DESCRIPTION AND COLOR CLAIM

 

The following statements describing color in the mark are added to the record:

 

The colors red, blue, yellow, grey, dark grey, black, white, and peach are claimed as a feature of the mark. 

 

The mark consists of the stylized grey wording “RHINOSHIELD” featured below a circular design that is half red and half blue. Inside the circle design is a stylized rhinoceros head design featured in light and dark grey.  The rhinoceros is wearing yellow and blue sunglasses, is featured with a peach colored nose patch, and features a white tooth with a black mouth.  The rhinoceros design is outlined in black.  All other white areas represent background and are not claimed as a feature of the mark.
