Dear Mr. Peet,

 

For some reason, the applicant’s last correspondence amended the application to the Supplemental Register, which is reserved for descriptive marks.  Since MAXSAFE is not considered a descriptive mark, it cannot register on the Supplemental Register.  The mark must register on the Principal Register, which was the original register requested in the initial application.  Furthermore, the applicant’s response added stippling statements which do not apply to the mark in this case.  Stippling appears as dashes in a mark.  I’ve removed the stippling statements from the record already and made a note to the file.  If you like, I can enter an Examiner’s Amendment withdrawing the applicant’s request to amend the application to the Supplemental Register.  I can then approve the mark for publication on the Principal Register.  To enter the Examiner’s Amendment, I need the approval of an officer of the applicant company.  This approval can be communicated by email or by phone.  Please note I cannot make return calls to phone numbers located outside the United States.
