Application has been amended as shown below.  The trademark examining attorney is amending the application as follows.  No prior approval or authorization from applicant or applicant’s attorney is required.  TMEP §707.02.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

IDENTIFICATION OF GOODS

The identification of goods in International Class 010 is amended to delete the duplicate entry of “Medical devices, namely, infusion pumps for delivering measured amounts of solutions into the bloodstream over time” and now reads as follows:

International Class 010:  Medical devices, namely, infusion pumps for delivering measured amounts of solutions into the bloodstream over time; diabetic diagnostic medical devices; Carrying case specifically adapted for carrying diabetic supplies, namely, blood glucose meter, testing strips and also including insulin and other related apparatus; Devices for measuring blood sugar; Devices for measuring blood sugar for medical purposes; Devices for monitoring blood glucose for medical purposes; Displays, monitors and controllers for medical fluid injectors, namely, computer displays and computer monitors and controllers therefor used in direct association with medical diagnosis apparatus; Displays, monitors and controllers for medical fluid injectors, namely, computer displays and computer monitors and controllers therefor used in direct association with medical fluid injectors; Disposable bottle liners for use with medical apparatus; Electromagnetic drug delivery apparatus for medical use; Injection device for pharmaceuticals; Medical apparatus and instrument for diagnostic use, namely, apparatus for medical cancer drug treatment; Medical apparatus and instruments for treating osteoarthritis, osteoporosis, osteotraumatic injuries, degenerative bone diseases and joint diseases; Medical apparatus and units for dosage, measuring and monitoring, namely, drug delivery devices and systems; Medical apparatus for introducing pharmaceutical preparations into the human body; Medical apparatus, namely, a spinal fusion device; Medical apparatus, namely, blood pump system for use in artificial liver support; Medical apparatus, namely, implantable ports; Medical devices, namely, tubing and valve assembly set and electromechanical fluidic instrument, and other similar or related devices, which process human whole blood for the purpose of separating human blood components for use in blood transfusions and washing human red blood cells with clinical medical reagents for use in blood transfusions; Medical fluid injectors; Medical tubing for fluid delivery; Needles for medical purposes; Orthopedic device for injecting drugs into joint spaces

See TMEP §§1402.01, 1402.01(e).  The identification of goods in International Class 009 is unaffected by this amendment.

The requirements raised in the January 25, 2019 Office action have been satisfied.
