NON-FINAL OFFICE ACTION
TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.
ISSUE/MAILING DATE: 2/7/2019
This letter responds to applicant’s communication filed on January 4, 2019. This is a non-final office action because new issues are raised by the amended identification of services.
The bold capitalized wording represents the examining attorney’s suggested changes. The brackets are used to highlight the indefinite wording and to provide a brief explanation of the issue.
For assistance with identifying and classifying goods and/or services in trademark applications, please see the online searchable Manual of Acceptable Identifications of Goods and Services at http://tess2.uspto.gov/netahtml/tidm.html.
Applicant may adopt the following identification, if accurate:
Class 41: Education and entertainment services, namely, a continuing web-based non-downloadable video series whereby [“consumers podcasts are disassembled piece by piece and explained” – whose podcasts? And why? What is the purpose? What does ‘disassembly’ mean in this context? Is it a critique? Is it a ‘how to make a podcast’? As written, no real subject is communicated.]
This requirement is maintained and continued.
Applicant is encouraged to call or email the assigned trademark examining attorney below to resolve the issues in this Office action. Although the USPTO will not accept an email as a response to an Office action, an applicant can communicate by phone or email to agree to a proposed amendment to the application that will immediately place the application in condition for publication, registration, or suspension. See 37 C.F.R. §2.62(c); TMEP §707.
