APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Karen Gaunt on April 3, 2019, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

Due to applicant’s amendment, the likelihood of confusion refusal and potential likelihood of confusion refusal are withdrawn.  TMEP §714.04.

 

IDENTIFICATION OF GOODS

 

The identification of goods is amended to read as follows:  “device for health and wellbeing, namely, a medical device that treats incontinence and provides therapeutic and medical benefits to sufferers of incontinence.”  See TMEP §§1402.01, 1402.01(e).

 

MARK DESCRIPTION

 

The following description of the mark replaces the current description of record:

 

            The mark consists of an incomplete circle, with a gap on the upper right hand side, that contains two vertical lines of equal length in the center and the wording PAUSE on the bottom.
