TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict between applicant’s mark and the mark in the referenced application. Applicant’s election not to submit arguments at this time in no way limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.
SECTION 2(e)(1) REFUSAL - MERELY DESCRIPTIVE
In this case, applicant’s seeks registration of REAL FLOWERS THAT LAST A YEAR in connection with “cut flowers” and “Online retail store services featuring flowers, floral bouquets and floral arrangements.”
As demonstrated by the attached dictionary evidence from Macmillan Dictionary, the term “real” means “not false or artificial,” a “flower” is “the colored part of a plant from which the plant’s fruit develops. A flower is often made up of many petals,” the term “last” refers to something that “used for referring to a period of time that has continued up to the present” and “a year” refers to “a period of 365 days.”
Thus, when the applied-for mark REAL FLOWERS THAT LAST A YEAR is used in connection with applicant’s goods and services, it immediately conveys to consumers that applicant provides flowers and retail store services featuring flowers that are not artificial and that remain fresh or unimpaired for a period of twelve months. The applied-for mark therefore merely describes a feature or characteristic of applicant’s services.
In addition, applicant’s website makes clear that the goods do last for an entire year. “Do Eternity® Roses Really Last a Year? Yes! With proper care, these delicate roses maintain their beautiful appearance for up to a year.” See the attached evidence from applicant’s website. Accordingly, applicant’s mark merely describes a feature of the applied-for goods and a feature of the goods sold via the applied-for services.
Only where the combination of descriptive terms creates a unitary mark with a unique, incongruous, or otherwise nondescriptive meaning in relation to the goods and/or services is the combined mark registrable. See In re Colonial Stores, Inc., 394 F.2d 549, 551, 157 USPQ 382, 384 (C.C.P.A. 1968); In re Positec Grp. Ltd., 108 USPQ2d 1161, 1162-63 (TTAB 2013).
In this case, both the individual components and the composite result are descriptive of applicant’s goods and services and do not create a unique, incongruous, or nondescriptive meaning in relation to the goods and services.
Accordingly, applicant’s mark is refused registration under Section 2(e)(1) of the Trademark Act.
SECTIONS 1, 2, 3, AND 45 REFUSAL – MARK IS MERELY INFORMATIONAL
Slogans and terms that are merely informational in nature, such as statements or laudatory phrases about goods and/or services ordinarily used in business or in a particular trade or industry, are not registrable. See In re Eagle Crest, Inc., 96 USPQ2d 1227, 1229 (TTAB 2010). Determining whether the slogan or term functions as a trademark or service mark depends on how it would be perceived by the relevant public. In re Eagle Crest, Inc., 96 USPQ2d at 1229; In re Aerospace Optics, Inc., 78 USPQ2d at 1862; TMEP §1202.04. “The more commonly a [slogan or term] is used, the less likely that the public will use it to identify only one source and the less likely that it will be recognized by purchasers as a trademark [or service mark].” In re Hulting, 107 USPQ2d 1175, 1177 (TTAB 2013) (quoting In re Eagle Crest, Inc., 96 USPQ2d at 1229); TMEP §1202.04(b).
The attached evidence from Allure.com, Bloomiere.com and Blooms by Heinau shows that this slogan or term as well as the wording “flowers that last a year” is widely used in the marketplace to indicate a type of real flower that has had its sap replaced with a glycerin-based moisturizer that preserves the flowers, which allows the flowers to live for about a year. Because consumers are accustomed to seeing this slogan or term used in this manner, when it is applied to applicant’s goods and services, they would perceive it merely as informational matter indicating a type of preserved flower. Thus, this slogan or term would not be perceived as a mark that identifies the source of applicant’s goods and services.
An applicant may not overcome this refusal by amending the application to seek registration on the Supplemental Register or asserting a claim of acquired distinctiveness under Section 2(f). TMEP §1202.04(d); see In re Eagle Crest, Inc., 96 USPQ2d at 1229. Nor will submitting a substitute specimen overcome this refusal. See TMEP §1202.04(d).
ASSISTANCE
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
