This Examiner’s Amendment responds to applicant’s communication dated 06/20/2019 where applicant:

 

(1)  Provided an amended identification of goods.

 

The examining attorney has reviewed the applicant’s response and determined the following:

 

(1)  Applicant’s amended identification of goods has been reviewed and is accepted. However, the amended identification included a duplicate entry which applicant has requested be removed from the identification through the Examiner’s Amendment below. Therefore, the Identification of Goods Requirement, Clarification of the Number of Classes for Which Registration is Sought requirement and Multiple Class Application Requirements advisory are satisfied.

 

(2)  Applicant has not provided a copy of the Foreign Registration Certificate. Therefore, the Foreign Registration Certificate Requirement is maintained and continued.

 

Application has been amended as shown below.  As agreed to by applicant’s attorney, Pamela Hirschman, on Friday, July 12, 2019, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods are not permitted.  37 C.F.R. §2.71(a).

 

IDENTIFICATION OF GOODS

 

The identification of goods is amended to read as follows: 

 

IC 032: Beverages, namely non-alcoholic beer, soft drinks, water beverages, fruit beverages, fruit flavored carbonated drinks, fruit flavored drinks, non-alcoholic beverages containing fruit juices, vegetable drink, non-alcoholic water-based beverages

WHAT HAPPENS NEXT:

 

Immediately following this letter, a suspension notice will be issued placing the application into suspension until the Foreign Registration Certificate has been received.
