ARGUMENT(S)
The Applicant submits that there is no likelihood of confusion between the applied-for THE SMART CHOICE mark and the cited prior registered SMARTCHOICES mark.

First of all, the marks themselves are not confusingly similar.  Applicant's mark is three separate words and indicates a singular term ("The ... Choice").  In sharp contrast, the Registered Mark is only one word and indicates a plural term ("choices").  Thus the marks are not similar in sight, sound or meaning.  This point is shown by the fact that the USPTO permitted the registration of the mark THE SMART GIRL'S CHOICE (Reg. No. 5,555,624) in Class 5 despite the prior registration of the cited SMARTCHOICES mark.

Further, the respective goods are not confusingly similar.  The Applicant's mark covers goods in classes 9, 25 and 28.  In contrast, the cited registration covers goods in classes 3, 5 and 25.  The cited registration covers NO goods in classes 9 or 28.  Therefore, the respective goods are not confusingly similar, and confusion is unlikely.
