Subject: Official Correspondence from the USPTO regarding two US Trademark Applications, Serial Number 88109599, SUITE RETREAT and 88109605, FARMHOUSE LIVING
Mr. Wang:
I am the Examining Attorney from the U.S. Patent and Trademark Office that has been assigned to review the applications you filed for trademark protection, Application Serial Nos. 88109599 and 88109605, for the marks SUITE RETREAT and FARMHOUSE LIVING.
I have completed my review of the applications and have determined the following requirements must be addressed in each application before the applications can be moved forward. These requirements are straight forward and can be corrected here at the Office using an Examiner’s Amendment.
Requirement:
1) Disclaimer:
a. As to SUITE RETREAT, Serial Number 88109599.
I must require a disclaimer of SUITE as to International Class 020, as it immediately describes a feature or characteristic of the applicant’s goods. Specifically, SUITE is defined as, “A set of matching furniture: a dining room suite”. Accordingly, this word immediately describes applicant’s Class 020 goods as applicant’s furniture can be sold as a set of matching furniture, or a SUITE. The disclaimer would appear as follows:
“No claim is made to the exclusive right to use “SUITE” as to International Class 020 apart from the mark as shown”.
b. As to FARMHOUSE LIVING, Serial Number 88109605.
I must require a disclaimer of FARMHOUSE as it immediately describes a feature or characteristic of the applicant’s goods. Specifically, FARMHOUSE identifies a particular style of furniture and bedding related goods – this wording describes the applicant’s goods as they are in a farmhouse style. The disclaimer would appear as follows:
“No claim is made to the exclusive right to use “FARMHOUSE” apart from the mark as shown”.
Please let me know if these amendments are acceptable. If so I will issue an Examiner’s Amendment, make the changes to the applications and move the applications forward. If the amendments are not acceptable or if you have further questions, please feel free to email me at the below email address, or call me at the phone number below.
I must take action on your application by 5pm EST on Friday, December 21. If I do not hear from you regarding the above mentioned requirements by that time, I will issue an Office Action with the information contained therein and you will have six (6) months to respond to the Office Action.
