In accordance with the discussion on April 25, 2019, with the Examining Attorney assigned to this application, Daniel Stringer, Applicant respectfully requests: (A) amendment of the identification of services in Classes 36 and 41; (B) division of Application Serial No. 88105797 for TREEHOUSE into two separate applications; and (C) withdrawal of the Section 2(d) refusal related to Class 36. 


Specifically, Applicant first requests the identification of services in Classes 36 and 41 be amended as follows:


Class 36: Charitable fundraising for children in foster care and at-risk children and youth; charitable fundraising for educational programs, activities, trips, clothing, and holiday gifts, for children in foster care and at-risk children and youth


Class 41: Providing educational services, namely, educational interventions in the nature of educational assessment services, and academic mentoring of school age children to support academic achievement, all the aforementioned services for children in foster care and at-risk children and youth; providing educational services, namely, counseling services in the field of educational development to help create student-centered educational plans to support individual student development, all the aforementioned services for children in foster care and at-risk children and youth; providing educational services, namely, academic performance monitoring and counseling to assist students in planning for further education, all the aforementioned services for children in foster care and at-risk children and youth; educational services, namely, conducting programs in the fields of academic tutoring at the middle school and high school level and counseling services in the field of educational development to help create student-centered educational plans to support individual student development, all the aforementioned services for children in foster care and at-risk children and youth


Next, Applicant requests that the services listed in Class 41 be divided from the goods and services listed in Classes 9 and 36, in order to allow the Classes 9 and 36 goods and services to proceed in the application process. 


Finally, with these proposed amendments, Applicant believes the cited likelihood of confusion is eliminated with respect to Class 36 and respectfully requests the Section 2(d) refusal be withdrawn.
