SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION

 

This refusal applies to the following goods only: “high strength polyethylene fibers sold as an integral component of outdoor clothing intended for skiing, climbing, mountaineering, and other outdoor sports, including parkas, shells and pants; high strength polyethylene fibers sold as an integral component of footwear; high strength polyethylene fibers sold as an integral component of mountaineering and climbing equipment, namely, slings, harnesses, cams, and other safety equipment; high strength polyethylene fibers sold as an integral component of backpacks and bags specially adapted for skiing, climbing and mountaineering; high strength polyethylene fibers sold as an integral component of tents, straps for trekking poles, and sleeping bags.”

 

Registration of the applied-for mark is refused because of a likelihood of confusion with the marks in U.S. Registration Nos. 2536921, 2289432.  Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.  See the attached registrations.

 

Trademark Act Section 2(d) bars registration of an applied-for mark that is so similar to a registered mark that it is likely consumers would be confused, mistaken, or deceived as to the commercial source of the goods of the parties.  See 15 U.S.C. §1052(d).  Likelihood of confusion is determined on a case-by-case basis by applying the factors set forth in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973) (called the “du Pont factors”).  In re i.am.symbolic, llc, 866 F.3d 1315, 1322, 123 USPQ2d 1744, 1747 (Fed. Cir. 2017).  Only those factors that are “relevant and of record” need be considered.  M2 Software, Inc. v. M2 Commc’ns, Inc., 450 F.3d 1378, 1382, 78 USPQ2d 1944, 1947 (Fed. Cir. 2006) (citing Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1241, 73 USPQ2d 1350, 1353 (Fed. Cir. 2004)); see In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1744 (TTAB 2018). 

 

Although not all du Pont factors may be relevant, there are generally two key considerations in any likelihood of confusion analysis:  (1) the similarities between the compared marks and (2) the relatedness of the compared goods.  See In re i.am.symbolic, llc, 866 F.3d at 1322, 123 USPQ2d at 1747 (quoting Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1164-65, 64 USPQ2d 1375, 1380 (Fed. Cir. 2002)); Federated Foods, Inc. v. Fort Howard Paper Co.,544 F.2d 1098, 1103, 192 USPQ 24, 29 (C.C.P.A. 1976) (“The fundamental inquiry mandated by [Section] 2(d) goes to the cumulative effect of differences in the essential characteristics of the goods [or services] and differences in the marks.”); TMEP §1207.01.

 

 

 

COMPARISON OF THE MARKS

 

Marks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression.  Stone Lion Capital Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1321, 110 USPQ2d 1157, 1160 (Fed. Cir. 2014) (quoting Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F.3d 1369, 1371, 73 USPQ2d 1689, 1691 (Fed. Cir. 2005)); TMEP §1207.01(b)-(b)(v).  “Similarity in any one of these elements may be sufficient to find the marks confusingly similar.”  In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018) (citing In re Davia, 110 USPQ2d 1810, 1812 (TTAB 2014)); TMEP §1207.01(b).

 

When comparing marks, “[t]he proper test is not a side-by-side comparison of the marks, but instead whether the marks are sufficiently similar in terms of their commercial impression such that [consumers] who encounter the marks would be likely to assume a connection between the parties.”  Cai v. Diamond Hong, Inc., __ F.3d __, 127 USPQ2d 1797, 1801 (Fed. Cir. 2018) (quoting Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1368, 101 USPQ2d 1713, 1721 (Fed. Cir. 2012)); TMEP §1207.01(b).  The proper focus is on the recollection of the average purchaser, who retains a general rather than specific impression of trademarks.  In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018) (citing In re St. Helena Hosp., 774 F.3d 747, 750-51, 113 USPQ2d 1082, 1085 (Fed. Cir. 2014); Geigy Chem. Corp. v. Atlas Chem. Indus., Inc., 438 F.2d 1005, 1007, 169 USPQ 39, 40 (CCPA 1971)); TMEP §1207.01(b).

 

Here, applicant’s mark is DYNEX in standard character form, and registrant’s marks are DYNEX in typed form and DYNEX SD in typed form.

 

The marks share the identical term DYNEX, which appears to have no meaning. Marks may be confusingly similar in appearance where similar terms or phrases or similar parts of terms or phrases appear in the compared marks and create a similar overall commercial impression.  See Crocker Nat’l Bank v. Canadian Imperial Bank of Commerce, 228 USPQ 689, 690-91 (TTAB 1986), aff’d sub nom. Canadian Imperial Bank of Commerce v. Wells Fargo Bank, Nat’l Ass’n, 811 F.2d 1490, 1495, 1 USPQ2d 1813, 1817 (Fed. Cir. 1987) (finding COMMCASH and COMMUNICASH confusingly similar); In re Corning Glass Works, 229 USPQ 65, 66 (TTAB 1985) (finding CONFIRM and CONFIRMCELLS confusingly similar); In re Pellerin Milnor Corp., 221 USPQ 558, 560 (TTAB 1983) (finding MILTRON and MILLTRONICS confusingly similar); TMEP §1207.01(b)(ii)-(iii).

 

Therefore, for the reasons discussed above, the marks have a similar commercial impression and, as such, are confusingly similar and are likely to cause confusion under Section 2(d) of the Trademark Act.

 

 

COMPARISON OF THE GOODS

 

The goods are compared to determine whether they are similar, commercially related, or travel in the same trade channels.  See Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1369-71, 101 USPQ2d 1713, 1722-23 (Fed. Cir. 2012); Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1165, 64 USPQ2d 1375, 1381 (Fed. Cir. 2002); TMEP §§1207.01, 1207.01(a)(vi).

 

The compared goods need not be identical or even competitive to find a likelihood of confusion.  See On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080, 1086, 56 USPQ2d 1471, 1475 (Fed. Cir. 2000); Recot, Inc. v. Becton, 214 F.3d 1322, 1329, 54 USPQ2d 1894, 1898 (Fed. Cir. 2000); TMEP §1207.01(a)(i).  They need only be “related in some manner and/or if the circumstances surrounding their marketing are such that they could give rise to the mistaken belief that [the] emanate from the same source.”  Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1369, 101 USPQ2d 1713, 1722 (Fed. Cir. 2012) (quoting 7-Eleven Inc. v. Wechsler, 83 USPQ2d 1715, 1724 (TTAB 2007)); TMEP §1207.01(a)(i).

 

Here, applicant has applied for the following relevant goods: “high strength polyethylene fibers sold as an integral component of outdoor clothing intended for skiing, climbing, mountaineering, and other outdoor sports, including parkas, shells and pants; high strength polyethylene fibers sold as an integral component of footwear; high strength polyethylene fibers sold as an integral component of mountaineering and climbing equipment, namely, slings, harnesses, cams, and other safety equipment; high strength polyethylene fibers sold as an integral component of backpacks and bags specially adapted for skiing, climbing and mountaineering; high strength polyethylene fibers sold as an integral component of tents, straps for trekking poles, and sleeping bags.”

 

Registrant’s goods for U.S. Reg. 2536921 are “Fiber used as a component of carpet.”

 

Registrant’s goods for U.S. Reg. 2289432 are “Fiber used as a component of carpet.”  

 

The goods are related because they are types of fibers.  In support of this relatedness, the following attached evidence from American Felt, Spunfab and Delaware Valley Corporation show that entities commonly provide fibers for different kinds of goods under the same mark through the same trade channels to the same classes of consumers.

 

Therefore, applicant’s and registrant’s goods are considered related for likelihood of confusion purposes.  See, e.g., In re Davey Prods. Pty Ltd., 92 USPQ2d 1198, 1202-04 (TTAB 2009); In re Toshiba Med. Sys. Corp., 91 USPQ2d 1266, 1268-69, 1271-72 (TTAB 2009).

 

Evidence obtained from the Internet may be used to support a determination under Section 2(d) that goods are related.  See, e.g., In re G.B.I. Tile & Stone, Inc., 92 USPQ2d 1366, 1371 (TTAB 2009); In re Paper Doll Promotions, Inc., 84 USPQ2d 1660, 1668 (TTAB 2007).  The Internet has become integral to daily life in the United States, with Census Bureau data showing approximately three-quarters of American households used the Internet in 2013 to engage in personal communications, to obtain news, information, and entertainment, and to do banking and shopping.  See In re Nieves & Nieves LLC, 113 USPQ2d 1639, 1642 (TTAB 2015) (taking judicial notice of the following two official government publications:  (1) Thom File & Camille Ryan, U.S. Census Bureau, Am. Cmty. Survey Reports ACS-28, Computer & Internet Use in the United States:  2013 (2014), available at http://www.census.gov/content/dam/Census/library/publications/2014/acs/acs-28.pdf, and (2) The Nat’l Telecomms. & Info. Admin. & Econ. & Statistics Admin., Exploring the Digital Nation:  America’s Emerging Online Experience (2013), available at http://www.ntia.doc.gov/files/ntia/publications/exploring_the_digital_nation_-_americas_emerging_online_experience.pdf).  Thus, the widespread use of the Internet in the United States suggests that Internet evidence may be probative of public perception in trademark examination.

 

Therefore, as the applicant’s mark is highly similar/identical to the registrant’s marks, and as the goods are related, there is a likelihood of confusion as to the source of the applicant’s goods and registration must be refused under Section 2(d) of the Trademark Act. 

 

Although applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support of registration.  However, if applicant responds to the refusal, applicant must also respond to the requirements set forth below.

 

 

IDENTIFICATION OF GOODS

 

Some of the wording in the identification of goods is indefinite and must be clarified.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Specifically, the wording “including” in the identification of goods is indefinite and must be deleted and replaced with a definite term, such as “namely,” “consisting of,” “particularly,” or “in particular.”  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03(a).  The identification must be specific and all-inclusive.  This wording is an open-ended term (e.g., “including,” “such as”) that is not acceptable because it fails to identify specific goods.   See TMEP §1402.03(a).

 

Some of the goods are misclassified. For example, “high strength polyethylene fibers” are misclassified and should be in Class 17.  The item “sleeping bags” is in Class 24, and “Straps for trekking poles” is in Class 18.  The wording “tents” is overly broad in Class 28 and applicant must further specify the nature of these goods and classify accordingly.

 

With respect to Class 28, applicant must specify the type of “slings,” “harnesses” and “cams” in Class 28. Applicant must also state the “other safety equipment” to make clear the nature of the goods in Class 28. 

 

Applicant may adopt the following identification, if accurate:

 

 

Class 17: high strength polyethylene fibers sold as an integral component of outdoor clothing intended for skiing, climbing, mountaineering, and other outdoor sports, including  in particular parkas, shells and pants; high strength polyethylene fibers sold as an integral component of footwear; high strength polyethylene fibers sold as an integral component of mountaineering and climbing equipment, namely, slings, harnesses, cams, and other safety equipment in the nature of {further specify}; high strength polyethylene fibers sold as an integral component of backpacks and bags specially adapted for skiing, climbing and mountaineering; high strength polyethylene fibers sold as an integral component of tents, straps for trekking poles, and sleeping bags

Class 25: Outdoor clothing intended for skiing, climbing, mountaineering, and other outdoor sports, including namely, parkas, shells and pants; footwear;  {misclassified, Class 17} high strength polyethylene fibers sold as an integral component of outdoor clothing intended for skiing, climbing, mountaineering, and other outdoor sports, including parkas, shells and pants;{misclassified, Class 17}  high strength polyethylene fibers sold as an integral component of footwear

 

Class 28: Mountaineering and climbing equipment, namely, climber slings, climber harnesses, cams in the nature of spring loaded camming devices, and other safety equipment in the nature of {specify the type of equipment}; backpacks and bags specially adapted for skiing, climbing and mountaineering; {overly broad, tents are in Class 22, play tents are in Class 28} play tents; {misclassified, Class 24}sleeping bags; {further clarify and classify accordingly} straps for trekking poles; {misclassified, Class 17} high strength polyethylene fibers sold as an integral component of mountaineering and climbing equipment, namely, slings, harnesses, cams, and other safety equipment; {misclassified, Class 17} high strength polyethylene fibers sold as an integral component of backpacks and bags specially adapted for skiing, climbing and mountaineering; {misclassified, Class 17} high strength polyethylene fibers sold as an integral component of tents, straps for trekking poles, and sleeping bags

 

 

Applicant may amend the identification to clarify or limit the goods and services, but not to broaden or expand the goods and services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and services may not later be reinserted.  See TMEP §1402.07(e).

MULTI-CLASS APPLICATION REQUIREMENTS

 

The application identifies goods in more than one international class; therefore, applicant must satisfy all the requirements below for each international class based on Trademark Act Section 1(b):

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.

 

(2)       Submit a filing fee for each international class not covered by the fees already paid (view the USPTO’s current fee schedule).  The application identifies goods and/or services that are classified in at least 6 classes; however, applicant submitted a fees sufficient for only 2 classes.  Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

INQUIRY – SIGNIFICANCE OF WORDING

 

To permit proper examination of the application, applicant must provide the following information:

 

(1)  Explain whether the wording in the mark “DYNEX” has any meaning or significance in the industry in which the goods are manufactured/provided, any meaning or significance as applied to applicant’s goods, or if such wording is a term of art within applicant’s industry. 

 

(2)  Explain whether this wording identifies a geographic place or has any meaning in a foreign language. 

 

(3)  Submit an English translation of all foreign wording in a mark. If the wording does not have meaning in a foreign language, applicant should so specify.   

 

The format for an English translation and transliteration: The English translation of “DYNEX” is “{submit translation}”. 

 

The format for when there is no English translation or meaning of the transliteration: The wording “DYNEX” has no meaning in a foreign language.
