SPECIMEN REFUSAL – Does Not Show Use of Mark with Class 20 Goods
An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of goods and/or services identified in the application or amendment to allege use. 15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
Examples of specimens for goods include tags, labels, instruction manuals, containers, photographs that show the mark on the actual goods or packaging, and displays associated with the actual goods at their point of sale. See TMEP §§904.03 et seq. Webpages may also be specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods. TMEP §904.03(i).
Applicant may respond to this refusal by satisfying one of the following for each applicable international class:
(1) Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing date of the application or prior to the filing of an amendment to allege use and (b) shows the mark in actual use in commerce for the goods and/or services identified in the application or amendment to allege use. A “verified substitute specimen” is a specimen that is accompanied by the following statement made in a signed affidavit or supported by a declaration under 37 C.F.R. §2.20: “The substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing date of the application or prior to the filing of the amendment to allege use.” The substitute specimen cannot be accepted without this statement.
(2) Amend the filing basis to intent to use under Section 1(b), for which no specimen is required. This option will later necessitate additional fee(s) and filing requirements such as providing a specimen.

IDENTIFICATION OF GOODS REQUIRES AMENDMENT
Applicant is advised to delete or modify the duplicate entry in the identification of goods services in International Class 20 for “picture frames”. See generally TMEP §§1402.01, 1402.01(a). If applicant does not respond to this issue, be advised that the USPTO will remove duplicate entries from the identification prior to registration.
If modifying one of the duplicate entries, applicant may amend it to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended. See 37 C.F.R. §2.71(a); TMEP §1402.06. Also, generally, any deleted goods and/or services may not later be reinserted. TMEP §1402.07(e).
Applicant may adopt the following amendment, if accurate, with suggested amendments underlined and in bold:

MARK DESCRIPTION REQUIRES AMENDMENT
The following description is suggested, if accurate:
The mark consists of the letters "SE" within a circle with the wording and words "SOUTHEASTERN” above the circle and the wording “INSTITUTE"
underneath the circle with all of the foregoing partially encircled by a circular seal design featuring laurel leaves and the wording "SOUTHEASTERN INSTITUTE" to the right of the
seal design. The drawing also contains a partial rectangular design at the top of the mark.
If the partial rectangular design is not intended to be a part of the mark, the applicant must provide a new drawing. See 37 C.F.R. §2.72; TMEP §§807.02, 807.14(a).
Although applicant may delete this matter, applicant may not make any other changes or amendments that would materially alter the applied-for mark on the drawing. See 37 C.F.R. §2.72; TMEP §§807.14 et seq. For more information about changes to the mark in the drawing after the application filing date, see the Drawing webpage.
DRAWING AND SPECIMEN DO NOT MATCH
Registration is refused because the specimen does not show the mark in the drawing in use in commerce all of the classes, which is required in the application or amendment to allege use. Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a), 1301.04(g)(i). The mark appearing on the specimen and in the drawing must match; that is, the mark in the drawing “must be a substantially exact representation of the mark” on the specimen. See 37 C.F.R. §2.51(a)-(b); TMEP §807.12(a).
In this case, the specimen displays the mark as SOUTHEASTERN INSTITUTE with the above-described circular design featuring laurel leaves. However, the drawing displays the mark as SOUTHEASTERN INSTITUTE with the above-described circular design featuring laurel leaves and with partial rectangular border. Therefore, the mark on the specimen does not match the mark in the drawing because the mark in the drawing also contains a partial rectangular design. Applicant has thus failed to provide the required evidence of use of the mark in commerce. See TMEP §807.12(a).
Applicant may respond to this refusal by satisfying one of the following:
(1) Submit a new drawing of the mark that shows
the mark on the specimen and, if appropriate, an amendment of the description and/or color claim that agrees with the new drawing. See 37
C.F.R. §2.72(a)-(b). The following amended description is suggested, if accurate: The
mark consists of the letters "SE" within a circle with the wording and words "SOUTHEASTERN” above the circle and the wording “INSTITUTE" underneath the circle with all
of the foregoing partially encircled by a circular seal design featuring laurel leaves and the wording "SOUTHEASTERN INSTITUTE" to the right of the seal design. Applicant may amend the mark in the drawing to match the mark on the specimen but may not make any other changes or amendments that would materially
alter the drawing of the mark. See 37 C.F.R. §2.72(a)-(b); TMEP §807.14.
(2) Submit a different specimen (a verified “substitute” specimen) for each applicable international class that (a) shows the mark in the drawing in actual use in commerce for the goods and/or services in the application or amendment to allege use, and (b) was in actual use in commerce at least as early as the filing date of the application or prior to the filing of an amendment to allege use.

UNNECESSARY §2(f) CLAIM
Applicant may withdraw this claim by instructing the trademark examining attorney to delete it from the application record. See id. If applicant does not withdraw the claim, it will remain in the application record and be printed on the registration certificate. See TMEP §1212.10.
A claim of acquired distinctiveness may be construed as a concession by applicant that the entire applied-for mark is not inherently distinctive. See Cold War Museum, Inc. v. Cold War Air Museum, Inc., 586 F.3d 1352, 1358, 92 USPQ2d 1626, 1629 (Fed. Cir. 2009) (citing Yamaha Int’l Corp. v. Hoshino Gakki Co., 840 F.2d 1572, 1577, 6 USPQ2d 1001, 1005 (Fed. Cir. 1988)); TMEP §1212.02(b).
