I am the Trademark Examining Attorney at the U.S. Patent and Trademark Office examining your client’s application for ULTRAEDGE (Serial No. 88100391), and I wanted to discuss the following issue with you.

 

Mark Description Requirement: The description of record is incomplete, as it does not note the inclusion of the color black in the surgical blade design. Accordingly, please let me know if you agree to the following amended mark description:

 

The mark consists of a blue representation of an eye to the left of the word "ULTRAEDGE" in black, except for the vertical line of the letter "D" being formed by a blue and black surgical knife.

 

If you agree to the amended mark description, I can make the changes for you via Examiner’s Amendment, and your client’s application may proceed toward registration.
