Application serial no. 88098832 SURGIVUE (Stylized and/or with Design, see http://tmng-al.uspto.gov /resting2/api/img/8809883 2/large) has been amended as follows:

EXPLANATION OF FILING

Applicant is filing this Post-Publication Amendment pursuant to TMEP § 1201.02(c), to correct Applicant's state of formation in connection with the application for the design mark SURGIVUE (Serial No. 88/098832).

Applicant is a Delaware limited liability company. When Applicant filed its application to register the SURGIVUE design mark, however, Applicant inadvertently listed the state of formation as Colorado. Applicant respectfully requests that that the PTO amend the application to reflect the Applicant is a Delaware limited liability company rather than a Colorado limited liability company. Applicant submits there was no Colorado limited liability company at the time of filing its application to register the SURGIVUE design mark. There is no new ownership of the application nor was there a transfer of trademark rights to the SURGIVUE mark. Pursuant to TMEP § 1201.02(c)(7), "if the party listed as the applicant did not exist on the application filing date, the application may be amended to correct the applicant’s name." Accordingly, Applicant requests that the PTO amend the application to reflect the Applicant is a Delaware limited liability company.
