This Office acknowledges receipt of applicant’s communication dated June 5, 2019, in which applicant stated: “Trademark Deceptively registered is Parablu (4465009) with logo is part of our India company which was registered earlier, it is our subsidiary company. Since we have changed our company logo and we want to protect our IP under Parablu, INC (US Company Entity), it has been filed as a wordmark. Kindly exempt the objection raised for our group company logo 4465009 and approve the current wordmark filed herein.”

INFORMATION REQUIREMENT

 

To permit proper examination of the application, applicant must submit additional information about the relationship between the applicant and the owner the cited mark.  See 37 C.F.R. §2.61(b); TMEP §§814, 1402.01(e).  Specifically, applicant must submit the following:

 

A statement about whether the applicant owns all or substantially all the outstanding stock of the Parablu Systems Pvt. Ltd. and thus controls the activities and operations of Parablu Systems Pvt. Ltd., including the selection, adoption and use of the trademarks.

 

Failure to comply with a request for information is grounds for refusing registration.  In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.  Merely stating that information about the goods or services is available on applicant’s website is an insufficient response and will not make the relevant information of record.  See In re Planalytics, Inc., 70 USPQ2d 1453, 1457-58 (TTAB 2004).
