Database Search: The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Summary of Issues Applicant Must Address
Refusal Based on Trademark Act Section 2(e)(1) – Descriptiveness of the Mark
Only where the combination of descriptive terms creates a unitary mark with a unique, incongruous, or otherwise nondescriptive meaning in relation to the goods or services is the combined mark registrable. See In re Colonial Stores, Inc., 394 F.2d 549, 551, 157 USPQ 382, 384 (C.C.P.A. 1968); In re Positec Grp. Ltd., 108 USPQ2d 1161, 1162-63 (TTAB 2013).
In this case, both the individual components and the composite result are descriptive of a feature of the applicant’s services and do not create a unique, incongruous, or nondescriptive meaning in relation to the services. The attached evidence demonstrates that the wording in the mark describes a feature of the services:
Because the applicant’s services are identified broadly enough to include providing advice and information about the management of phantom inventory,” the term “phantom inventory” is descriptive of a feature of the services. The examining attorney finds that because the proposed mark merely describes the applicant’s services, registration of the applicant’s mark is barred under Section 2(e)(1) of the Trademark Act.
Additional Information Regarding Descriptiveness
(1) Fact sheets, instruction manuals, brochures, advertisements and pertinent screenshots of applicant’s website as it relates to the services in the application, including any materials using the terms in the applied-for mark. Merely stating that information about the services is available on applicant’s website is insufficient to make the information of record.;
(2) If these materials are unavailable, the applicant should submit similar documentation for services of the same type, explaining how its own services will differ. If the services feature new technology and information regarding competing services is not available, the applicant must provide a detailed factual description of the services. The factual information must make clear what the services are and how they are rendered, salient features, and prospective customers and channels of trade. Conclusory statements will not satisfy this requirement.; and
(3) The applicant must respond to the following questions: Do the applicant’s services include advice, information, or management of phantom inventory? Do the applicant’s competitors use the term “phantom inventory” to advertise a feature of their services? Given that “phantom inventory” a general term used in the retail industry, how is this term not descriptive of the applicant’s services?
