Dear Mr. Samporna:
This letter confirms receipt of your petition to revive the above-identified application filed on March 17, 2020. This application was abandoned for failure to file a statement of use in response to a notice of allowance issued on March 19, 2019. A statement of use or a request for extension of time to file a statement of use was due on or before September 19, 2019.
The Office received the first extension request filed with the petition. However, during the pendency of the petition, the second extension request became due on March 19, 2020. Therefore, further consideration of the petition is withheld and petitioner must submit the second extension request and fee (<$125 per class, if filed electronically, or $225, per class, if filed on paper>). 37 C.F.R. §2.66. Please note that in addition, the third extension request or a statement of use will become due on or before September 19, 2020. Filing a petition does not stay the time for filing these papers. 37 C.F.R. §2.89(g); TMEP §§1108.05 and 1714.01(b)(i).
Please submit the second extension request and fee of $125 within sixty (60) days from the mailing date of this letter. If no response is received within sixty (60) days, the petition will be denied, without consideration on the merits and the application will remain abandoned.
