Subject: FW: Application No. 88092824 for COOBY - ONE ADDITIONAL QUESTION

I have issued the priority office action.

I just wanted to make sure of one thing.

Currently, the application identifies you as:

“Huang Xiaoxia”  – with “Huang” as the given name or first name and “Xiaoxia” as the last name or surname.

Is this correct?  Or should your first name be identified as “Xiaoxia” and your last name as “Huang’?

If it needs to be changed, please let me know and I will take care of it here.

Thank you

Susan

You will need to submit an amendment to change the filing basis. I will issue a priority office action, once you get the priority office action, please call me with any questions you have about filing the response.

As soon as you submit an amendment to change the filing basis, the application will be approved.

Thank you

Susan

There is one issue in the application that must be addressed before the application can be approved.

The specimen, or evidence of use of the mark, submitted with the application is not acceptable because it is a printout of the Applicant’s logo.

Acceptable specimens for the beds for pets would include images of tags or labels applied to the goods or an image of the goods (the pet beds) showing or bearing the mark.  The use of the new specimen (or evidence of use of the mark COOBY) as of the filing date of the application must be supported with an affidavit or declaration

If it is acceptable with you, I would like to issue a priority office action requesting that you submit an acceptable specimen (or sample of use of the mark) along with a declaration supporting use of the substitute specimen as of the filing date of the application.

If I do not hear from you, I will simply issue an office action

Thank you and I look forward to your reply

Susan Richards
