Good afternoon Terrence,
I am the trademark attorney in the above referenced trademark application. I reviewed the application and I am withdrawing the Trademark Section 2(d) Refusal based on Applicant’s arguments. However, an identification amendment is required in Class 17 to proceed with publication.
In specific, The wording “woven plastic in sheet and fabric form” in the identification of goods for International Class 17 must be clarified because it is too broad and could include goods in other international classes. See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03. Plastic sheets are generally classified according to function or purpose of the goods: Class 16 for “wrapping or packaging” purposes, and Class 17 for “packing” or non-wrapping purposes, as well as plastics in extruded form for use in further manufacture. In addition, plastic sheet material for use as a drop cloth, or for use in preventing weed growth, will be classified in Class 17. Plastic sheet material used to prevent erosion will be classified in Class 19. Plastic or vinyl sheet material that performs a tarp-like function (e.g., unfitted swimming pool or hot tub covers, unfitted vehicle covers, unfitted, tarp-like liners for the cargo areas of pick-up trucks) is classified in Class 22. Plastic film for industrial or commercial packing is in Class 17. Food wrapping plastic film for household use and plastic film for packaging are classified in Class 16. Please see Office Action dated December 17, 2018 for detailed explanation.
Accordingly, the following wording is suggested and may be adopted if accurate:
Class 17: Woven plastic in the form of sheets for use in further manufacturing of tarpaulins for agricultural, horticultural, industrial, and domestic use
Class 22 is acceptable as provided.
Upon your authorization, I will be happy to issue an Examiner’s Amendment to expedite processing of this application. Please let me know whether you agree to this amendment and/or have questions by June 14, 2019. I look forward to your reply.
