Dear Mr. WANG,
Your application for registration referenced above cannot be approved for publication because of two issues.
First, the application does not include a disclaimer of the descriptive term “primer.”
The services consist of nail care salon and beauty salon services, both of which use primer.
Therefore, the word “primer” in the mark describes a key feature of the services and the exclusive right to this term apart from the mark as a whole must be disclaimed.
Second, the description of the mark is incomplete because it does not clearly specify which parts of the mark are in black, including the line.
Please indicate in a response to this message (1) whether you consent to the addition of the necessary disclaimer statement and (2) provide an amended, complete mark description.
If both are acceptable, I will add the necessary statements for you so that the application may proceed.
Sincerely,
Edward Fennessy
