The petition to the Director filed on February 18, 2019 for the above-identified trademark application is GRANTED pursuant to 37 C.F.R. §2.146(a)(3).
The application will be returned to the assigned examining attorney to consider the request to amend the basis from Section 1(b) to Section 44(e) of the Trademark Act. If the amendment is accepted the application will be republished. If the amendment is refused, applicant will be notified of the refusal.
Since you have requested to substitute the Section 44(e) basis, the notice of allowance will be cancelled and the Section 1(b) basis will be deleted. The application will then be forwarded to the examining attorney to examine the amendment to substitute Section 44(e) as the basis for registration. The Section 1(b) basis cannot be reinserted.
