I. IDENTIFICATION AMENDMENT REQUIRED
If accurate, applicant may adopt the following identification in their appropriate international classes:

personalization of self-branded products at the direction of customers, namely, fragrances, beauty products, eyeglasses and sunglasses, cases and covers for portable electronic devices, jewelry,

II. MARK DESCRIPTION AMENDMENT REQUIRED
The following description is suggested, if accurate: The mark consists of the word “COACH” on top of the word “CREATE”; with the word “COACH” forming part of an incomplete rectangular shape with rounded edges and the word “CREATE” appearing inside the incomplete rectangular shape with rounded edges. This formation of the words “COACH”, “CREATE” and the incomplete rectangular shape are contained within another rectangle with curved edges that has vertical broken line on either side.
III. DISCLAIMER REQUIRED
In this case, applicant must disclaim the wording CREATE because it is not inherently distinctive. These unregistrable term at best are merely descriptive of feature or characteristic of applicant’s services. See 15 U.S.C. §1052(e)(1); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012); TMEP §§1213, 1213.03(a).
The attached evidence from the Merriam-Webster dictionary shows this wording means “to produce through imaginative skill; design.” Thus, the wording merely describes applicant’s services because a feature of applicant’s online retail store services is that consumers can design their own pieces (“featuring customization and personalization of self-branded products”). The additional attached evidence from applicant’s website shows applicant using this word in a way that reinforces the descriptiveness of the word (“You Create It. We Craft It.”). Applicant’s website then goes on to describe the creation process.

RESPONSE GUIDELINES
