I would like your permission to amend the identification of goods for all the above applications. Currently, the identification is “motor land vehicles, namely, automobiles, sport utility vehicles, trucks, vans, engines therefor and structural parts thereof” in International Class 12. As written, the wording is overbroad and indefinite; the wording ‘structural parts thereof’ could be interpreted as modifying both the vehicles themselves (which is definite in Class 12), as well as the engines (which is classified in Class 7). Accordingly, please let me know if you agree to the following amended identification (changes in bold):
“Motor land vehicles, namely, automobiles, sport utility vehicles, trucks, vans, and engines therefor; motor land vehicles, namely, automobiles, sport utility vehicles, trucks, vans and structural parts thereof” in International Class 12.
If you give me permission to make this amendment to the identification, I can issue an Examiner’s Amendment for all the above applications.
In addition, upon issuing the Examiner’s Amendment, I will also be issuing a Suspension Letter, as there is a prior pending application for XT (Serial No. 86469665) that has a conflict with all the above applications.
