A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.
ISSUE/MAILING DATE: 6/3/2019
THIS IS A FINAL ACTION.
This Office action is in response to applicant’s communication filed on 5/2/2019.
In a previous Office action(s) dated 11/30/2018, applicant was required to satisfy the following requirement(s): amend the identification of goods and/or services and comply with classification requirements.
Based on applicant’s response, the trademark examining attorney notes that the following requirement(s) have been satisfied: identification of goods. See TMEP §§713.02, 714.04.
The following refusal(s) have also been obviated: classification requirements. See TMEP §§713.02, 714.04.
Further, the trademark examining attorney maintains and now makes FINAL the refusal(s) and/or requirement(s) in the summary of issues below. See 37 C.F.R. §2.63(b); TMEP §714.04.
SUMMARY OF ISSUES MADE FINAL that applicant must address:
FOREIGN REGISTRATION CERTIFICATE REQUIRED
The document submitted by applicant is an extract of the register and is not acceptable. Applicant must submit a copy of the foreign registration certificate to support the Section 44(e) basis. See, TMEP §1004.01.
A copy of a foreign registration must consist of a document issued to an applicant by, or certified by, the intellectual property office in the applicant’s country of origin. TMEP §1004.01. If an applicant’s country of origin does not issue registrations or Madrid Protocol certificates of extension of protection, the applicant may submit a copy of the Madrid Protocol international registration that shows that protection of the international registration has been extended to the applicant’s country of origin. TMEP §1016.
Therefore, applicant must provide a copy of the foreign registration from applicant’s country of origin. If the foreign registration is not written in English, applicant must also provide an English translation. 37 C.F.R. §2.34(a)(3)(ii); TMEP §1004.01(a)-(b). The translation should be signed by the translator. TMEP §1004.01(b).

(2) an appeal to the Trademark Trial and Appeal Board filed using the Electronic System for Trademark Trials and Appeals (ESTTA) with the required filing fee of $200 per class.
