STRICT DEADLINE TO RESPOND TO THIS LETTER

TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.  A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

This Office action is in response to applicant’s communication filed on February 7, 2019.

 

Upon further review, the assigned trademark examining attorney inadvertently omitted a requirement for an amendment to the identification of goods.  See TMEP §§706, 711.02.  The trademark examining attorney apologizes for any inconvenience caused by the delay in raising this issue. 

 

The requirement for a substitute specimen has been satisfied.  See TMEP §713.02. 

 

The following is a SUMMARY OF ISSUES that applicant must address:

 

CLARIFICATION OF IDENTIFICATION OF GOODS REQUIRED

 

THIS PARTIAL REQUIREMENT APPLIES ONLY TO THE GOODS SPECIFIED THEREIN

 

The wording “metal patio covers” in the identification of goods is indefinite and must be clarified because it does not make clear the specific type of “patio covers”.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant must amend this wording to specify the common commercial or generic name of the goods.  See TMEP §1402.01.  If the goods have no common commercial or generic name, applicant must describe the product, its main purpose, and its intended uses.  See id.

 

Applicant may substitute the following wording, if accurate, with proposed changes in bold:

 

            Class 6:  Metal patio covers in the nature of metal awnings and metal lattices; metal pergolas

 

Applicant may amend the identification to clarify or limit the goods, but not to broaden or expand the goods beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods may not later be reinserted.  See TMEP §1402.07(e).

RESPONSE GUIDELINES

 

For this application to proceed, applicant must explicitly address each refusal and/or requirement in this Office action.  For a refusal, applicant may provide written arguments and evidence against the refusal, and may have other response options if specified above.  For a requirement, applicant should set forth the changes or statements.  Please see “Responding to Office Actions” and the informational video “Response to Office Action” for more information and tips on responding.

 

If applicant does not timely respond to this Office action, “metal patio covers” will be deleted from the application.  See 37 C.F.R. §2.65(a); TMEP §718.02(a). 

 

In such case, the application will then proceed with “metal pergolas”.  See TMEP §718.02(a).
