DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
ISSUES APPLICANT MUST ADDRESS: On November 20, 2018, the trademark examining attorney and attorney of record, Paul Kruse, discussed the issues below. Applicant must timely respond to these issues. See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.
SUMMARY OF ISSUES
IDENTIFICATION OF GOODS REQUIREMENT
If applicant’s “apparel” is in International Class 025, applicant may amend the identification to insert the word “namely,” after “apparel” and then list the specific types of clothing items in that class (e.g., shirts, pants, coats, dresses). Based on the Class specified by the applicant in the application, the Examining attorney has provided a suggested identification for Class 025 goods only. However, if this wording does not accurately describe the applicant’s goods, the applicant must amend to the proper identification and classification. If the applicant adds additional Classes, they must also follow the multi-class guidelines below.
Applicant may substitute the following wording, if accurate (suggested edits in bold):
Class 025: Children’s apparel, namely, [applicant to specify the type of apparel in Class 025, e.g. shirts, pants, jackets, shorts, socks, etc.]; Ladies and children’s accessories, namely, [applicant to specify the type of accessories in Class 025, e.g. gloves, hats, belts for clothing, etc.]

CLARIFICATION OF NUMBER OF CLASSES TO BE REGISTERED REQUIREMENT
Therefore, applicant must either (1) restrict the application to the number of classes covered by the fees already paid, or (2) submit the fees for each additional class.
The fee for adding classes to a TEAS Reduced Fee (RF) application is $275 per class. See 37 C.F.R. §§2.6(a)(1)(iii), 2.23(a). See more information regarding the requirements for maintaining the lower TEAS RF fee and, if these requirements are not satisfied, for adding classes at a higher fee using regular TEAS.
MULTIPLE-CLASS APPLICATION ADVISORY
(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee already paid (view the USPTO’s current fee schedule). The application identifies goods that could be classified in at least 4 classes; however, applicant submitted a fee sufficient for only 1 class. Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.
