I am the attorney assigned to U.S. Trademark Application No. 88059895 for MAGICAL SEASON. I have reviewed the application and there is a minor issue preventing its approval.
The identification of goods is indefinite. Specifically, the wording “apparel” and “accessories” needs to be specified as to the type of apparel and accessories. The following wording is suggested:
Class 025: Children’s apparel, namely, [applicant to specify the type of apparel, e.g. shirts, pants, jackets, shorts, socks, etc.]; Ladies and children’s accessories, namely, [applicant to specify the type of accessories, e.g. gloves, hats, belts for clothing, etc.]
Also, be advised that “accessories” could encompass goods outside of Class 025 (e.g. purses in Class 018). If the specification of accessories includes any goods outside of Class 025, the applicant will need to add the additional Classes and pay additional fees.
Please respond to this email ASAP with the proposed changes to the ID, and I will make the changes myself to expedite the publication process.
