The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
Summary of Issues
This non-final Office action contains the following issues that applicant must address:
Search Results Under Trademark Act §2(d)
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Recitation of Services
Class 41: Entertainment services in the nature of an ongoing reality based television program in the field of {specify, e.g., interior design, personal wardrobe styling}
For assistance with identifying and classifying goods and services in trademark applications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual. See TMEP §1402.04.
Disclaimer Required
In this case, applicant must disclaim the word DESIGN in the mark because it is not inherently distinctive. These unregistrable term at best is merely descriptive of an ingredient, quality, characteristic, function, feature, purpose, or use of applicant’s goods and/or services. See 15 U.S.C. §1052(e)(1); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012); TMEP §§1213, 1213.03(a).
The attached dictionary evidence defines "interior design" as a professional field of designing and/or arranging the décor for interior spaces such as homes and businesses. The word DESIGN on its own is commonly used to identify the field, as is demonstrated in the attached third-party registrations for entertainment services in the field of interior design. Applicant's recitation of services is phrased broadly enough to encompass entertainment services specifically featuring design, such that the word DESIGN is merely descriptive for a featured subject matter of those services.
Applicant may respond to this issue by submitting a disclaimer in the following format:
No claim is made to the exclusive right to use “DESIGN” apart from the mark as shown.
For an overview of disclaimers and instructions on how to satisfy this issue using the Trademark Electronic Application System (TEAS), see the Disclaimer webpage.
