Dear V. Richter,
Thank you for your 4/26 response regarding your trademark application for PREMIER (Serial No. 88052901). I am the Trademark Examining Attorney at the United States Patent and Trademark Office reviewing and I wanted to discuss the following issue with you.
Identification of Goods/Services: As amended, the identification of goods for Class 30 includes explanatory language from the attorney’s original suggestion (e.g., “indicate other components”), and is thus indefinite. Assuming it is accurate, I propose amending to the following (changes in bold, deletions in strikethrough):
Class 30: biscuits; breakfast cereals; brownies; cakes; cereal-, rice-, and wheat-based snack foods, cheese-flavored crackers; cones for ice cream; cookies; cracker sandwiches; crackers; filled and unfilled wafers; flavored popcorn; granola-based snack bars; pie crusts; popped popcorn; pretzels; processed cereal-based food to be used as a breakfast food; processed cereals; puffed cheese corn snack; ready-to-eat cereals; snack cakes; snack mix consisting primarily of crackers, pretzels, candied nuts and/or popped popcorn; tortilla chips; candy; chocolate and frozen confections; gummy candies; fruit snacks; soup nuts; trail mixes consisting primarily of granola, pretzels, popcorn, and crackers and also including
indicate other components, e.g.,dried fruit, chocolate, and processed nuts, etc.; cheese, potato, corn, and grain-based snack foods
