NONFINAL OFFICE ACTION

 

The USPTO must receive applicant’s response to this letter within six months of the issue date below or the application will be abandoned.  Respond using the Trademark Electronic Application System (TEAS).  A link to the appropriate TEAS response form appears at the end of this Office action.

Although the above-referenced trademark was approved for registration on July 11, 2020, the registration will not issue until the following remaining issue has been resolved.

 

Copy of Certification Standard Required

 

Copy of certification standards required.  Applicant must submit a copy of the standards used to determine who is authorized to use the certification mark.  See 37 C.F.R. §2.45(a)(4)(i)(B); TMEP §1306.03(b).  These standards must cover the full scope of the goods and/or services identified in the application, not just a subset of the goods and/or services.  TMEP §1306.03(b).  For example, if the goods are “olive oil,” but the standards are only for “extra virgin olive oil,” applicant must submit standards for all types of olive oil or amend the identification to “extra virgin olive oil.”  Id.

 

Further, applicant is not required to create the standards; they may be established by another party, such as a government agency or private research organization.  Id.

 

How to provide the certification standards. 

After opening the appropriate TEAS response form:

(1)        Answer “Yes” to form wizard question #3 and click “Continue; 

(2)        On the “Additional Statement(s)” page, check “Miscellaneous Statement” and in the text box enter a statement that a copy of the standards are being attached; and

(3)        Click the box for attaching a file under that statement, and attach a copy of the standards.
