STRICT DEADLINE TO RESPOND TO THIS LETTER

TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.  A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

THIS IS A FINAL ACTION.

 

INTRODUCTION:

 

The Office is in receipt of applicant’s incoming communication dated March 20, 2019.

 

The dates of use requirement has only been satisfied for Class 14 only. 

 

The Class 14 ID requirement is satisfied.

 

The following requirements are now made FINAL: 

 

  • Dates of use for Classes 25 & 35 only; and

 

  • An acceptable specimen for Class 35

 

See 37 C.F.R. §2.63(b).

 

DATES OF USE OMITTED FOR CLASS 25 & 35 ONLY:

 

The application does not include the required dates of first use of the mark for Classes 25 & 35 only.  An application based on use in commerce under Trademark Act Section 1(a) must include both (1) the date of first use of the mark anywhere and (2) the date of first use of the mark in commerce, even if they are the same.  15 U.S.C. §1051(a)(2); 37 C.F.R. §2.34(a)(1)(ii)-(iii); TMEP §§903, 903.03. 

 

Therefore, applicant must provide these two dates of first use, verified with an affidavit or signed declaration under 37 C.F.R. §2.20 for Classes 25 & 35.  See 37 C.F.R. §§2.34(a)(1)(ii)-(iii), 2.193(e)(1); TMEP §903.

UNACCEPTABLE SPECIMEN FOR CLASS 35:

 

Registration is refused because the specimen does not show the applied-for mark in use in commerce in International Class 35.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a), 1301.04(g)(i). 

 

The original specimens are unacceptable for the following reasons: 

 

Specifically, the Class 35 specimen is a “shirt bearing the mark”.  A shirt is a good.  Class 35 is for services and not goods. 

 

No substitute specimens for Class 35 were submitted in the most recent response. 

 

An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of services identified in the application or amendment to allege use.  15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a). 

 

Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and webpages that show the mark used in the actual sale, rendering, or advertising of the services.  See TMEP §1301.04(a), (h)(iv)(C).  Specimens comprising advertising and promotional materials must show a direct association between the mark and the services.  TMEP §1301.04(f)(ii).

 

Applicant may respond to this refusal by satisfying one of the following for each applicable international class:

 

(1)       Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing date of the application or prior to the filing of an amendment to allege use and (b) shows the mark in actual use in commerce for the services identified in the application or amendment to allege use.  A “verified substitute specimen” is a specimen that is accompanied by the following statement made in a signed affidavit or supported by a declaration under 37 C.F.R. §2.20:  “The substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing date of the application or prior to the filing of the amendment to allege use.”  The substitute specimen cannot be accepted without this statement.

 

(2)       Amend the filing basis to intent to use under Section 1(b), for which no specimen is required.  This option will later necessitate additional fee(s) and filing requirements such as providing a specimen.

OPTIONS:

 

Applicant must respond within six months of the date of issuance of this final Office action or the following classes to which the final requirements applies to will be deleted from the application by Examiner’s Amendment: 

 

  • Class 25

 

  • Class 35

The application will then proceed for the following class:    

 

  • Class 14

 

Applicant may respond by providing one or both of the following:

 

(1)       a response filed using the Trademark Electronic Application System (TEAS) that fully satisfies all outstanding requirements and/or resolves all outstanding refusals; and/or

 

(2)       an appeal to the Trademark Trial and Appeal Board filed using the Electronic System for Trademark Trials and Appeals (ESTTA) with the required filing fee of $200 per class.
