SEARCH OF OFFICE RECORDS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
The following wording in the identification of goods is indefinite and must be clarified because it is unclear what types of goods are provided:
Printed publications, namely, brochures, booklets, and teaching materials in the field of learning the English language or Chinese language, in class 16.
Baby harness, in class 18.
Baby seat; Baby barrier, in class 20.
Non-alcoholic beverages, in class 32.
See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant must amend the identification to specify the common commercial or generic name of the goods. See TMEP §1402.01. If the goods have no common commercial or generic name, applicant must describe the product, its main purpose, and its intended uses. See id.
Applicant may adopt the following wording, if accurate:
Baby barrier, namely, metal safety gates for babies, in class 6.
Baby seat, namely, safety seats for babies for motor cars, in class 12.
Stickers; Printed publications, namely, brochures, booklets, and teaching materials in the field of learning the English language and Chinese language; Comic books, picture books, in class 16.
Schoolchildren's backpacks; Umbrellas for children. Luggage; baby harness, namely, harnesses for guiding babies, in class 18.
Toy boxes; Bassinets; Baby seat, namely, [specify type, e.g. high chairs for babies[; Baby crib; Baby walker; Baby barrier, namely, non-metal safety gates for babies, in class 20.
Fruit juice; Soda pops; Mineral water; Drinking water; Non-alcoholic beverages flavored with tea; [specify type of “non-alcoholic beverages,” e.g. Non-alcoholic fruit juice beverages]; Malt beer, in class 32.

DISCLAIMER STATEMENT
Applicant must disclaim the wording “BABY” because it merely describes an ingredient, quality, characteristic, function, feature, purpose, or use of applicant’s goods and/or services, and thus is an unregistrable component of the mark. See 15 U.S.C. §§1052(e)(1), 1056(a); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re Oppedahl & Larson LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); TMEP §§1213, 1213.03(a).
The definition of the term “baby” is “A very young child; an infant.” See attachments http://www.ahdictionary.com/word/search.html?q=baby. The wording “baby” indicates the goods are for infants and the services are related to babies. Therefore, the wording merely describes a characteristic of the goods and services.
An applicant may not claim exclusive rights to terms that others may need to use to describe their goods and/or services in the marketplace. See Dena Corp. v. Belvedere Int’l, Inc., 950 F.2d 1555, 1560, 21 USPQ2d 1047, 1051 (Fed. Cir. 1991); In re Aug. Storck KG, 218 USPQ 823, 825 (TTAB 1983). A disclaimer of unregistrable matter does not affect the appearance of the mark; that is, a disclaimer does not physically remove the disclaimed matter from the mark. See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 978, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP §1213.
If applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark. See In re Stereotaxis Inc., 429 F.3d 1039, 1040-41, 77 USPQ2d 1087, 1088-89 (Fed. Cir. 2005); TMEP §1213.01(b).
Applicant should submit a disclaimer in the following standardized format:
No claim is made to the exclusive right to use “BABY” apart from the mark as shown.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.
